The oil and gas industry is seeking to dismiss a climate lawsuit in Pennsylvania, arguing that leaders of Bucks County, a county just north of Philadelphia, violated the state’s Sunshine Act. The motion was filed by 14 fossil fuel producers and the American Petroleum Institute. If successful, it would be the first attempt to hold the oil industry accountable for climate disasters exacerbated by climate change. The lawsuit argues that the public was never given an opportunity to consider whether the county should enter the legal fray. The county commissioners approved the case at a properly-formed public meeting, violating Pennsylvania’s public records law by not authorizing the lawsuit.
