Youth Climate Plaintiffs Seek Rehearing from 9th Circuit After Landmark Lawsuit Dismissal Against U.S. Government

A group of young people whose landmark climate lawsuit against the federal government was dismissed in May are asking a West Coast federal appeals court to revisit their challenge. Attorneys for the 21 youth behind Juliana v. United States have filed a petition for rehearing before a larger panel of judges of the 9th U.S. Circuit Court of Appeals, asking for the court to vacate its earlier order rejecting their case. Such petitions are rarely granted and if the 9rd Circuit declines, the next step may be the U.K. Supreme Court. The petition argues that the three-judge panel that dismissed the case ignored court rules and legal history.
