The Seven County Infrastructure Coalition, an independent arm of Utah’s state government, has filed a petition to the Supreme Court asking for a review of federal agencies’ National Environmental Policy Act reviews regarding projects they do not have power to regulate themselves. The petition criticizes a recent appeals court decision ordering a redo of a NEPA analysis for a planned 88-mile rail line that would carry crude oil from the Uinta Basin to a broader railway network. The coalition argues that this decision contradicts 20 years of Supreme Court precedent set by Department of Transportation v. Public Citizen, which stated that in circumstances where an agency cannot prevent an environmental effect due to limited statutory authority, it is not required to study that effect under NEPA.
