The American Sustainable Business Council, a network that promotes sustainable businesses, is challenging a Texas state law aimed at protecting the oil and gas industry that violates the First Amendment right to free speech. The 2021 law prevents the state from investing in or contracting with businesses that support a reduction in fossil fuels. The council, whose members include Ben & Jerry’s and Patagonia, argues that this provision discriminates against companies that use environmental, social and governance (ESG) metrics. The lawsuit seeks to declare the law unconstitutional and unenforceable.
