Supreme Court to Review Biden Administration’s EPA Rule Limiting Power Plant Pollution Amid Legal Challenges.

The Supreme Court is set to review the EPA’s rule to limit power plant pollution, a rule issued by the Biden administration, which is the nation’s second-largest source of climate pollution. The conservative-dominated Supreme Court has ruled that the rule fails to comply with a previous ruling by West Virginia v. EPA, which invalidated the Obama administration’s attempt to shift the electric grid to renewable sources, also restricts the federal government’s power to regulate expensive and politically divisive regulations. West Virginia Attorney General Patrick Morrisey has vowed to challenge the Biden rule in court against what he calls an “out-of-control” agency.
