Four decisions are expected next week, which could potentially overturn EPA controls on cross-state smog pollution, expose old rules to new lawsuits, and potentially demolish a 40-year-old doctrine that helps environmental regulators win in court. These decisions are among about a dozen decisions still pending from the Supreme Court. The Chevron doctrine, which argues courts should yield to regulators’ interpretation of statutes like the Clean Air Act, has fallen out of favor with the conservative-dominated Supreme Court and some justices have advocated for ending it. The consequences of this could be amplified if the court decides to open old federal rules to legal challenges.
