The Supreme Court is facing calls to undermine EPA’s efforts to reduce greenhouse gas emissions from the power sector for a second time. The National Rural Electric Cooperative Association (NRECA) and Republican state attorneys general have filed separate requests to the Supreme Court’s emergency docket to stop EPA’�s rule limiting greenhouse gas emission from existing coal and new gas-fired power plants. The applicants argue that the rule exceeds EPA’s authority and should be put on ice while opponents make their case to a lower court. A court order freezing the Biden rule could delay federal standards to address pollution from the nation’ second-largest source of greenhouse gases. If former President Donald Trump wins a second term, his administration would likely ensure that such a rule is never implemented.
