Supreme Court Denies Alaska’s Appeal on Mine Veto, Rejects Climate Lawsuit Relocation Efforts by Oil Companies.

The Supreme Court has rejected a request by the state of Alaska to revisit a federal veto of a massive mine, an attempt by oil companies to remove themselves from a climate lawsuit, and a petition from West Coast farmers seeking more water from the Klamath River Basin. The decision represents a significant setback to Alaska Gov. Mike Dunleavy’s administration, which has asked the high court to undo EPA’s decision to block Pebble and similar extraction projects on state land in southwestern Alaska. Alaska officials argue that the EPA’s veto, issued under a rarely used Clean Water Act authority, infringes on their sovereignty and ability to regulate its lands and waters. The Supreme Court also rejected a bid by American Petroleum Institute v. Minnesota to move climate liability lawsuits out of state courts.
