Twenty-five Republican-led states have filed a lawsuit against the Environmental Protection Agency (EPA) in the U.S. Court of Appeals for the District of Columbia Circuit, challenging the Biden administration’s rule to address emissions from existing coal-fired power plants and new gas facilities. The lawsuit also seeks to temporarily stop President Joe Biden’s power plant rule from going into effect. West Virginia Attorney General Patrick Morrisey, who led the Supreme Court challenge to the Obama-era Clean Power Plan, promised a repeat victory against EPA and its new rule. The National Rural Electric Cooperative Association also announced a lawsuit criticising the rule, calling it “unlawful, unreasonable and unachievable”. Supporters argue that EPA has stayed within its statutory authority to reduce individual emissions from individual plants.
