Environmental group Friends of the Earth is launching a lawsuit against the Department of Energy (DOE) for approving a $1.1 billion loan to keep California’s Diablo Canyon nuclear power plant from shutting down. The group claims that the DOE approved the loan without completing an updated National Environmental Policy Act review of the effects of extending the facility’s life span. The complaint alleges that the agency adopted a more than 50-year-old environmental analysis by the Nuclear Regulatory Commission and other outdated NEPA documents to meet its obligations under the law instead of completing its own original or supplemental review.
