A second federal judge has overturned a rule by the Biden administration that required state and local transportation officials to set greenhouse gas emissions targets for federally funded highway and road projects. The Federal Highway Administration’s rule exceeded its statutory authority, according to Judge Benjamin Beaton of the U.S. District Court for the Western District of Kentucky. Beaton called the rule “arbitrary and capricious” and a regulatory “regulatory elephant squeezed into a statutory mousehole.” This decision comes less than a week after another federal judge in Texas also overturned the rule nationwide.
