Federal Judge Rejects North Carolina Landowner’s Challenge to Biden Administration’s Wetlands Regulation Enforcement.

A federal judge has denied a bid by North Carolina landowner Robert White to block enforcement of the Biden administration’s wetlands regulation, stating that the lawsuit against the policy is unlikely to succeed. White is suing EPA and the Army Corps of Engineers over their efforts to regulate wetlands on his property, which are adjacent to a creek and a river. Environmental advocates argue that this could result in a wide swath of wetlands losing federal protections. Judge Terrence Boyle, a Reagan appointee, dismissed White’s request for a preliminary injunction and appeared skeptical of White’s broader legal argument.
