The Environmental Protection Agency (EPA) has moved to reinstate an Ohio air quality safeguard, which was removed from the state’s clean air plan in 2020 due to 2020. The rule, which allows Ohioans to sue polluting businesses in federal court, was removed after the 6th U.S. Circuit Court of Appeals agreed to allow the agency to revisit the 2020 decision in response to a lawsuit brought by the Sierra Club and other challengers. EPA officials admit to failing to follow their own procedures and failing to adequately consider the rule’s use in enforcing National Ambient Air Quality Standards. If reinstated, Ohioans suffering pollution will again be able to protect themselves.
