Liberty Energy and Nomad Proppant Services, two energy companies that won a temporary stay against a first-of-its-kind Biden administration climate disclosure rule, are asking the 8th U.S. Circuit Court of Appeals to prevent the Securities and Exchange Commission rule from taking effect pending judicial review. The request follows a decision by the 5th US. Circuit to dissolve a week-old stay it had issued against the rule due to lawsuits challenging the corporate disclosure requirements having been reassigned to the eightth Circuit. The companies argue that the rule would affect a significant portion of public companies’ SEC filings and lead to increased enforcement and litigation.
