Diablo Energy Storage LLC, a 200MW battery energy storage system (BESS) in Pittsburg, California, has filed a cross-complaint against Fluence, seeking a refund for its contract for its work on the Diablo BESS EPC contract. The court document alleges a series of technical failures attributed to Fluence’s poor workmanship, which led to overheating, downtime for maintenance, and removal from grid operator CAISO’s ancillary service market. The cross complaint was filed by law firm law firming. Diablo alleges that Fluence failed to maintain a valid license at various times during performance, violating California law. The company also accuses Fluence of failing to address and resolve warranty items and chronic failures of essential systems. Despite these issues, Fluence has denied the allegations in a 10-K filing stating it intends to vigorously defend against them.
