Democrats and Republicans are offering competing legislation to bolster or abolish rules following a Supreme Court ruling that has significantly increased the federal government’s regulatory power. The GOP is targeting energy and environmental regulations they have long opposed, following the Loper Bright Enterprises v. Raimondo decision, which ended the Chevron doctrine, which instructed courts to defer to agencies’ reasonable interpretations in developing rules for ambiguous statutes. Democrats are advocating for reinstating Chevron, arguing that agencies, not judges, have the technical expertise required to create complex regulations.
