Court Upholds FERC’s Approval of Tennessee Gas Pipeline, Rejecting Advocates’ Lawsuit for More Impact Analysis.

A three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit has rejected a lawsuit by advocates challenging the Federal Energy Regulatory Commission (FERC) for failing to fully analyze the impact of the Tennessee Gas Pipeline Co. project. The ruling stated that FERC had not required more information about other pipeline projects and had not set aside a certificate for the project. Judge Gregory Katsas, who was nominated by former President Donald Trump, stated that no request from FERC regarding additional information from Tennessee Gas would have yielded useful information.
