Biden Administration Implements New Policy to Notify Tribes on Mineral Exploration Proposals on Federal Lands

The Biden administration has introduced a new policy to ensure tribes are notified of proposals to explore for minerals on federally managed land. The Bureau of Land Management (BLM) has stated that these notifications do not require environmental analyses or consultation under laws like the Endangered Species Act or the National Historic Preservation Act. This move is intended to increase early communication and avoid costly and time-consuming court battles. The policy is in response to tribes’ concerns about a lack of communication about new mining projects.
