The Biden administration is in an effort to salvage civil rights regulations in Louisiana, which target unintended “disparate impacts” in assessing racial discrimination complaints. The regulations were previously blocked by a preliminary injunction from EPA to investigate the effects of Clean Air Act permitting decisions on Black communities in Louisiana. Louisiana’s lawyers are asking U.S. District Judge James Cain Jr. to throw out the regulations, arguing that the legal defects in them are “irremediable” and that the disruption to EPA will only be limited to a few investigations. The Justice Department has accused Louisiana of attempting to gut rules that have been on the books for over a half-century.
