8th Circuit to Hear Legal Challenge Against SEC’s Climate Disclosure Rule Amidst Conflicting Interests and Opinions.

The 8th U.S. Circuit Court of Appeals in Missouri will hear the legal battle over the Securities and Exchange Commission’s landmark climate rule, which requires corporations to disclose their climate risk. The case was assigned to the Judicial Panel on Multidistrict Litigation, which had been tasked with deciding which of several federal circuit courts would handle the case. Republican-led states, energy companies, and environmental groups had sued over the SEC rule in at least a half-dozen federal appeals courts. Conservative challengers argue that the regulation exceeds SEC’s authority, while green groups want tougher requirements. The attorneys general of Iowa, Arkansas, Idaho, Missouri, Montana, Nebraska, North Dakota, South Dakota and Utah, as well as the American Free Enterprise Chamber of Commerce, had filed suit in the 8th Circuit.
